BP and the Gulf Coast Oil Spill Claims

The BP oil spill had terrible consequences. There were tragic deaths that could have been avoided; the environment faced one of the most difficult challenges ever in America\’s long history and a shameful number of people lost the ability to work and trade daily because their livelihoods were dependent on the waters that had been infiltrated with millions of barrels of oil. The environment was in a desperate situation and the people who were losing their daily incomes were facing things that were even worse.

The world cut British Petroleum no slack whatsoever especially in view of the fact that the company\’s CEO Tony Hayward went out of his way to deny responsibility and then be foolish enough to go on a luxurious vacation, making no attempt to hide what he was doing. People wanted BP to pay for its part in the catastrophe and that is exactly what the government pushed the company to do: pay out the billions of dollars in claims and lawsuits that it now owed to millions of people whose lives the company had nearly destroyed.

The Gulf Coast claims facility was BPs answer to setting up a separate entity to deal with all the BP oil spill claims pouring in. BP released to the press a statement as well as saying that a $20 billion fund had been set up as part of their efforts in dealing with all the BP claims. It seemed on the surface that the British company was actually making a lot of effort in giving people the compensation they deserved because of everything that they had suffered through, but now it has emerged that the Gulf Coast claims are being subjected to something else entirely.

The man in charge of taking care of oil spill claims, Mr. Kenneth Feinberg, has made it clear that people who have refused to settle upon a specific sum of money as compensation and are instead trying to get more from the company may end up with a lot less than that which was initially offered to them. Every claimant who is about to be handed over some money by BP has to sign an agreement that he or she will never sue BP in the future over the oil spill, regardless of any future consequences of the disaster in their personal lives. It is a lot to ask for and many people have adamantly refused to sign such an agreement and make it easier on BP by settling for small sums of money that they could get very quickly.

BP however has stated clearly that it is being very generous about the settlement money being given out to the millions of claimants and that the payouts are designed with future losses well in mind. It seems that few people have any reason to believe what the company is saying. In fact the attorney general of Mississippi has advised people not to sign the agreement to not sue BP over its part in the oil spill disaster.
