Your friend or loved one has been arrested. The judge has ordered a surety bond as an option to remaining in jail until court appearance. What does this mean? What is a surety bond and what liability does it carry?

In simple terms, a surety bond is a contract between the defendant, the court and the bail bondsman. The contract, which is preferred by many courts, states that the bondsman ensures the appearance of the defendant at each required court date. Surety bonds are usually co-signed by a friend or family member and are secured by collateral. Most often this collateral is in the form of a home or any tangible asset equal to or greater than the value of the bond. A lien is placed on the asset until such time as all court proceedings have concluded, with the defendants\’ appearance as required, and the trial has come to an end. With collateral at stake, the defendant is less likely to flee. If the defendant chooses to flee despite the presence of a surety bond, he or she will be sought, apprehended, arrested and foreclosure proceedings against the property may be initiated by the bondsman.

While there is much at stake in imposing a surety bond, many times a defendant is released on personal recognizance. What does this mean? Simply stated, the defendant signs an agreement that he or she agrees to show for all appointed court dates until the case has been determined or concluded.

Release on Personal Recognizance will be granted based on several factors. The most common are the severity of the crime, such as non-violent or technical crimes, misdemeanors and whether or not this is a first offence. Familial obligations and employment are also factors the judge may consider.

Many times the judge will impose contingencies on the ROR (release on personal recognizance), such as attending rehabilitation classes, curfews and even stay-away orders, depending on the charges. If these contingencies and obligations are not met by the defendant, arrest is imminent.
